The typical business associate agreement is a set of obligations imposed upon the business associate. It is therefore customary to view these agreements as one by which the covered entity burdens the business associate. Depending on how much bargaining power the covered entity has determines how complicated and onerous the business associate agreement might be. There are many ways that these agreements can be abused. This video reviews different abuses, including those that raise operational concerns over whether the business associate’s policies and procedures satisfy the business associate agreement’s requirements.
