Allergies and Odor Sensitivities and Whether They Are Protected by the ADA

This 30-minute video will take you through the basics of what allergies are and how they are caused, types of odor sensitives, and how these are perceived to the Americans with Disabilities Act.

This video will teach you to look to the law to see what the employer’s obligations are and what the rights of the employees are in connection with the provisions in the Americans with Disabilities Act. The EEOC’s goal is to “Deter employers from routinely challenging whether an individual seeking “reasonable accommodation” has a disability”. Find out how the changes in the ADA along with the passing of the ADAAA in 2008 have impacted whether allergies and odor sensitivities are protected by the ADA.

Video faculty speaker Nancy L. Gunzenhauser is an associate in the Labor and Employment practice, in the New York office of Epstein Becker & Green, P.C. She counsels clients on compliance with EEO laws, the American with Disabilities Act, the Family and Medical Leave Act, worker classification issues, and other federal, state, and local statutes governing the workplace.
