As of September 2016, Texas became the only state that permits employers to 'opt-out' of the workers' comp system. Should your business be a Subscriber or Nonsubscriber? What are the benefits and what are the risks? Assuming an employer elects to provide workers' compensation benefits to its employees, how should the employer address issues related to injuries (including pre-existing injuries) and determining who is covered under the workers' comp policy? What happens when an injured worker attempts to return to work, or fails to return after being released? Finally, how should employers handle workplace discipline after an injury, including discipline connected to and unrelated to the events leading to the workplace injury. This topic will cover key considerations to enable employers to understand the risks and benefits of the opt-out system and develop comprehensive programs that balance the needs of the employee and the needs of the employer.
