Wisconsin Worker's Compensation - Emerging Issues and Strategies

The Wisconsin Worker’s Compensation Act (WCA) has undergone significant changes in its 116 year history; however, in 2016, the WCA underwent one of the most-significant legislative amendments in recent years. Insurance carriers, HR personnel, TPAs, self-insured employers, and employees are usually only made aware of these changes on a piecemeal basis when specific issues arise, and are left without any understanding as to the breadth of those changes. The first section of this topic helps explain those procedural and substantive changes, as well as provides a micro and macro analysis of the impact of those changes on the entire worker’s compensation system in Wisconsin.
Recent industrial trends have shown employers strive to have a healthy workforce, and are implementing wellness programs to facilitate the overall wellbeing of their employees. The second section of this material addresses the increasing trend of employer-sponsored wellness programs offered to employees. The focus is on how these wellness programs do improve overall employee health, which leads to less work-related injuries, less lost-time related to those injuries, and the corollary of lower insurance premiums. However, management-oriented personnel need to be aware of certain pitfalls where injuries have been found to be work-related while engaged in those wellness programs. This section will provide key insights for management-oriented personnel to mitigate any negative impacts of a wellness program.
When work injuries occur, management-oriented personnel need to know how to properly document work injuries in the event of litigation. This final section provides management-oriented personnel with the proper tools to effectively document work injuries to expedite treatment, return employees back to work, and also provide sufficient information later in time in the event of litigation.
