Understanding and Complying With Disclosures Under Rule 26(a)

Rule 26(a) of the Federal Rules of Civil Procedure imposes obligations to make a number of 'Required Disclosures' in federal civil litigation. Many states have adopted similar rules. Because Rule 26(a) has been revised in recent years, and because many practitioners assume that minimal initial disclosures can suffice, they may misunderstand the importance of compliance with the Rule. Failure to comply with disclosure obligations can result in sanctions, in a variety of forms, and can complicate the process of litigation.
