Learn how to effectively use scientific and technical experts to settle disputes.
Disputes involving environmental and construction issues, like other highly technical disputes, commonly require the use of experts. This slide deck is geared to help the person responsible for cost-effective and timely resolution of disputes, understand how technical experts can be used more cost-effectively and productively, in resolving technical or scientific based disputes. The concept of hot tubbing experts from Australian courts is reviewed. Recent case studies are described with new approaches and structures for using experts more effectively including mediation, advisory panels, dispute review boards and court reforms. This slide deck will show how these concepts can improve the resolution process in time, cost and the quality of outcomes. In particular these methods are most helpful to nontechnical judges (or law makers) making important scientific or technical-based decisions, which sometimes could have lasting effects beyond the case at hand. These benefits can be summarized as increased efficiency and efficacy in the necessary use of experts in narrowing issues, finding solutions and resolving disputes, and doing so at far less cost and time when parties are committed to improving the process.
