Rules of Ohio Trust Administration

The Ohio Trust Code isn’t new anymore, but attorneys, counselors, and advisors still need to know what duties and responsibilities it imposes on trustees. Many attorneys who prepare estate planning trusts pay little attention to the duties and obligations of the trustee of those trusts, and don’t spend a great deal of time discussing those matter with clients to be sure that the named trustee can actually do the job. The job involves more than just investing assets properly. The Ohio Trust Code codified many aspects of Ohio’s common law on the administration of trusts, but also imposes new duties that, in some cases, are more complex than those that existed before. This topic will help trust grantors, trustees, and the persons who advise them understand what a trustee needs to do to comply with the fiduciary duties imposed by Ohio law and, just as important, avoid personal or fiduciary liability for improper actions. Trust administration is an area of increased litigation and liability, and this seminar is critical to prepare counselors and advisors to identify potential controversies and equip them to proactively avoid or resolve those problems. A trust plan that is mired in ongoing litigation seldom accomplishes a trust grantor’s intent, so it is important to know these very important rules.
