Rules and Guidelines When Dealing With Statute of Limitations

Understand the applicable statute of limitations and recognize when the statute of limitations may bar a claim.

Many litigators recognize that the statute of limitations is one of the most important factors to consider in bringing or defending against a claim or cause of action, but are unsure of how to navigate that issue to their client’s best advantage. This topic helps litigants understand how and when to advance or defend against a statute of limitations affirmative defense in litigation or regulatory enforcement actions. The material will explain the most common types of statutes of limitation, how to assess when a statute of limitation begins to run and circumstances in which it may be tolled, and how to craft statute of limitations arguments effectively in legal proceedings. Failing to understand the applicable statute of limitations and recognize when the statute of limitations may bar a claim can have a devastating impact on a client’s ability to pursue that claim and may in some cases act as a total bar on the client’s ability to seek legal relief with respect to that cause of action. This information is critical for litigators and clients so that they can ensure that they understand the impact that the statute of limitations can have on all manner of legal proceedings.
