Rule 502: Attorney-Client Privilege and Work Product Limitations on Waiver

 

Understand the elements of privilege and protection, and how they relate to Rule 502 and inadvertent disclosures.

Knowing and preserving the attorney-client privilege and work product protection is fundamental for most litigators. Rule 502 of the Federal Rules of Evidence has been adopted to clarify and resolve common disputes regarding the effects of certain disclosures otherwise protected by the privilege or work product, including inadvertent disclosures and the agreement of the parties regarding disclosure.
This topic will discuss the elements of the privilege and protection, and then apply the provisions of Rule 502 to intentional and inadvertent disclosures of protected information. There will also be a discussion regarding the duties of a party who receives inadvertently disclosed information that appears to be protected by the privilege or work product doctrine. This information will be of interest to anyone involved in litigation.
