The United States Department of Labor (U.S. DOL) has allocated $277 million to the Wage and Hour Division for fiscal year 2016. This includes over $31 million for the hiring of additional wage and hour enforcement staff and support, and $10 million in grants for states, including New York, to improve their enforcement efforts, making wage and hour compliance more critical than ever for employers. To further complicate compliance, the U.S. DOL has recently proposed new regulations, which are likely to go into effect in 2016. This topic will explain the forthcoming U.S. DOL regulations and various New York-specific regulations to assist employers in planning ahead and evading the ever increasing federal and state enforcement efforts. Identify the appropriate tests and criteria to apply when classifying workers as exempt from overtime or as independent contractors.
