Make sure you are in compliance with New York’s drug testing laws.
Drug and alcohol abuse negatively impacts numerous aspects of a private employer’s business: safety, productivity, employee performance, morale, turnover and more. Often these impacts are readily apparent, but frequently they are not, and the time to address them is before they do irreparable harm to not only your business, but to the lives of your employees and their families. While New York has no state law directly prohibiting a private employer from implementing a drug and alcohol testing program, numerous other legal requirements present potential pitfalls for the unwary. This information helps the persons responsible for administering human resources programs to understand how to first establish and implement a drug and alcohol testing program, and then how to operate it in such a way as to avoid violating the rights of the employee participants. Topics of discussion will include testing protocols, unemployment insurance claims, Family Medical Leave Act issues, disability discrimination issues and general litigation avoidance.Agenda
