Illinois became the 11th state - along with the District of Columbia - to legalize recreational marijuana on January 1, 2020. Though federal law has remained largely unchanged, recreational marijuana continues to be legalized across several states and enforcement for personal consumption is virtually nonexistent. Many companies have growing concerns regarding Illinois' cannabis law. How do employers maintain a safe and drug-free workplace? How do they protect themselves against litigation? This topic will address employment law and how Illinois' cannabis law interplays with federal enforcement, using the construction industry as a case model.
