In practice, however, this is not as simple as it sounds, especially in an age where law firms are continuing to grow, practices are becoming more and more specialized, and lawyers are often forming unique of counsel relationships with other lawyers and law firms. As a result, lawyers often find themselves having to identify and at times defend apparent conflicts of interest either to a court or to clients. This topic will help lawyers identify conflicts of interest at the intake stage of a representation and also help lawyers understand what to keep in mind throughout the representation to make sure that a conflict does not arise. You will learn the rules governing current clients, prospective clients and former clients and how these rules interact with one another. The topic will also address the law surrounding disqualification motions and ethical screens in state and federal court.
