Legal Ethics - Minnesota's Rules of Professional Conduct

Historically speaking, a practicing lawyer in Minnesota has about a 1-in-20 chance of facing an ethics complaint at some point in any given year. Add in the potential for separate malpractice or criminal liability, and increase the number of years in practice and clients served, and your chances of facing a complaint or lawsuit can go up. While such odds may be acceptable to some, ethics and related complaints against lawyers stem from circumstances that in many cases may have been avoided entirely. Improper client identification and the failure to use ethically written fee engagements, overlooking conflicts of interest, and not knowing the difference between acceptable multi-jurisdictional practice and the unauthorized practice of law are sources of ethical and civil complaints each year against Minnesota attorneys. This topic will help Minnesota-licensed attorneys avoid these pitfalls by teaching viewers how to craft a well-written engagement agreement, identify common and not-so-common conflict of interest issues, and color in to a greater extent the thin line separating acceptable cross border representation from the unauthorized practice of law in other states.
