The Kansas Water Appropriation Act empowers the Chief Engineer of the Kansas Department of Agriculture, Division of Water Resources to control, conserve, regulate, allot, and aid in the distribution of the State’s water resources 'for the benefits and beneficial uses of all of its inhabitants in accordance with the rights of priority of appropriation.' The Chief Engineer has the power to adopt and enforce reasonable regulations as necessary to discharge these duties. The Act allows owners to apply to change the place of use, the point of diversion, or the use made of existing water rights without losing their place in the line of priority. Because much of the state is closed to applications for new appropriations, purchasing existing water rights and changing them to a new use is becoming much more important.
