This topic will address major issues regarding coverage provided by comprehensive general liability (CGL) policies for claims arising in the construction industry - in particular construction defect claims.
Although the material will also reference to a lesser extent certain other types of insurance policies such as builders risk property insurance, professional liability, and umbrella/excess, the primary focus will be on CGL policies. The topic will discuss how to interpret CGL policies including declarations, definitions, insuring agreements, conditions, exclusions and endorsements. The content will discuss in detail coverage analysis as it relates to the duty to defend and the duty to indemnify. In addition, the topic will address more than twenty of the most common exclusions to coverage for construction related claims including the Your Products, Your Work, Faulty Workmanship, Expected Injury, Contractual Liability, and Professional Services Exclusions.
