Developments in Wage and Hour Law in New Jersey

According to the Department of Labor, approximately 70% of employers are operating in violation of the federal Fair Labor Standards Act and state laws, such as the New Jersey wage and hour law. This is a particularly risky time for employees due to recent initiatives by the U.S. Department of Labor to expand the number of white collar employees eligible for overtime, recent decisions by New Jersey and federal courts regarding independent contractors, as well as the increase in wage and hour lawsuits and enhanced focus on wage and hour audits by the New Jersey Department of Labor and Workforce Development and the U.S. Department of Labor. These audits can result in significant back pay obligations and penalties, and lawsuits carry the additional risk of punitive damage awards and obligations to pay the plaintiff’s attorneys’ fees and costs. This topic will help employers to protect themselves from such risks and liabilities by familiarizing them the current and evolving requirements under New Jersey and federal law for classifying employees as exempt or nonexempt from statutory overtime requirements. This topic also will educate people responsible for human resources, hiring, classifications and payroll to understand the standards used to determine if a worker properly is classified as an independent contractor and what steps to take to ensure contractors truly are independent.
