Attorneys, Nicole Noel and David Byars, of Kass Shuler Law Firm will discuss Collections Etiquette and the laws that govern the collection practice as well as certain ethical considerations. This presentation will discuss common fraud based defenses to a collections action and how to overcome them, best practices for internal procedures and processes when a Debtor claims there is fraud or improper activity on their account and what is the responsibility of the Creditor to investigate. Specifically, presenters will discuss the Electronic Fund Transfer Act under Reg E 'EFTA' and what are the Creditor's duties under same.
