Privacy law has emerged as one of the most dynamic legal fields today, and counsel practicing in this area need to have a ready familiarity with the ever-increasing (and ever-changing) state and federal laws most likely to impact their clients. As the first state law to require certain websites to post a privacy policy, the California Online Privacy Protection Act (CalOPPA) has been one of the most important state laws in the field since it was enacted in 2004, and the 2013 amendments to the law expanded its scope. Accordingly, it is critical that counsel working in this field have a basic understanding of CalOPPA’s requirements and how to comply with its dictates – whether or not they are based in California. This topic provides an introduction to CalOPPA and its requirements and the possible consequences of noncompliance.
