Residential landlord and tenant law affects most Californians in some way, as housing is a basic necessity. Given the increasing cost of housing in California, more jurisdictions are discussing and considering the adoption of rent and eviction control systems. Some believe they should be passed statewide. In existing rent and eviction control jurisdictions like San Francisco, Los Angeles, Berkeley, Sana Monica, and Oakland, the regulatory systems with which residential landlords, managers, and their attorneys must contend have become increasingly more complex. The development of residential landlord and tenant case law in California usually involves issues arising in these jurisdictions, and 2015 has been no exception. This topic will analyze and discuss case law development in residential landlord-tenant law in 2015. It will explore the issues decided by the courts in 2015, and suggest practical solutions where available. Discuss current issues from 2015 case law involving fair housing, unlawful detainer law and procedure, the Ellis Act, the Costa Hawkins Rental Housing Act, constitutional rights, and preemption problems. This information will greatly educate any attorney, manager, owner, or professional concerning the kinds of legal issues and problems that practitioners face on a daily basis in a highly-regulated residential rental markets.
