There are many different types of liens that are created by statute or common law, including mortgage liens, construction/mechanics liens, attorneys' liens, UCC liens, and surety liens, as well as Court imposed equitable liens. Although detailed bodies of law exist for the perfection and priority of lien claims within the same class or category, there is very little guidance as to the perfection and priority of competing types of lien claims. There is also a common misperception that certain types of liens, including mortgage liens, are automatically given priority. This topic will provide a detailed background as to how competing lien claims are treated and resolved by the Courts.
This material will provide guidance as to the resolution of a variety of complex lien issues and scenarios. Advice will be given that is both preventative and resolution oriented. The content includes a section on lien theory that is intended to aid in the resolution of 'out of the box' lien issues.
