Problems arose when more and more citizens turned to the courts for relief and flooded the system. Currently, most courts have a back load of cases. We frequently refer to the court docket as being "clogged," reflecting the amount of time it takes for any particular case to be resolved in court. While most courts require that a case be tried within 12- 18 months, it is customary for complex construction cases to take 36 months or more to
complete, excluding the appeals process.
