Public Contracts and Procurement Regulations in New Jersey: Going to Court

In the usual case, the construction attorney will receive a telephone call from his/her client, a public contractor, complaining that it submitted a bid on a public project and, upon review, the bids submitted by one or more lower numeric bidders failed to comply with some portion of the bidding documents. In order to address such an issue, the client should appear at its attorney’s office as soon as possible with a copy of the bidding documents, as well as a copy of its own bid, for review.1

Many times a client will point to a “minor” defect in the other bids which may be so trivial that it has no bearing upon the bids. Counsel should be aware of the requirements of Local Public Contracts Law (“LPCL”, N.J.S.A. 40A:11-1 et seq.) and the decisions which relate to providing a responsive bid.2
