Payroll Issues of Domestic Partners and Same-Sex Spouses

 
The area of providing benefits to same-sex spouses, civil unions, and domestic partners is a rapidly developing area of law. Over time and at the same time, more and more employers have decided to revise one or more of their plans to offer benefits to the same-sex partners of employees. In some cases, such as benefits provided by governmental employers or under insured plans, developments in state law have led to employers being required to extend such benefits. In all cases, the decision to extend benefits raises issues in terms of plan decision, taxation, and reporting.
