Ohio Mechanic's Lien Law for Private Projects

 
Section 1311.02 provides that every person who performs work or labor, or furnishes
materials, in furtherance of any improvement pursuant to a contract (express or implied) with the owner, part owner or lessee of any interest in real estate, has a lien to secure payment therefore upon the improvement and all interests the owner, part owner or lessee1 has or may acquire in the land or leasehold to which the improvement was made. Further, every person who as a subcontractor, laborer or materialman performs any labor or work or furnishes materials to an original contractor (or any subcontractor) in carrying forward, performing or completing any improvement likewise has a lien to secure payment therefore. Ohio Rev. Code § 1311.02. A mechanic’s lien will be strictly construed when a question arises as to whether there has been proper perfection. See, e.g., Manpower, Inc. v. Phillips, 177 Ohio St. 45 (1962). The rule of liberal construction of Section 1311.22 only applies to post-attachment matters, once there has been a determination that all the procedural requirements for perfection have been followed.
