HITECH Act: Impact and Compliance Issues

 
This report will address the HITECH Act and the adoption and modification of the HITECH Act’s provisions by the Omnibus Rule. As it relates to the HITECH Act and the Omnibus Rule, this material will discuss: (1) the role of business associates and subcontractors to health care providers and other covered entities and (2) the motivation behind the HITECH Act’s concentration on the adoption of electronic medical records (“EMRs”). The distinguishing features between the HITECH Act and the Omnibus Rule will also be reviewed. As noted earlier, to the extent entities are already compliant with the HITECH Act, many of the requirements of the Omnibus Rule will have been met.
