Guardianships and Conservatorships in Arizona

 
When an individual is unable to manage his or her personal or financial decisions a court proceeding can be started to ensure the individual is protected from physical harm.

I. Filing for Guardianship
A. Guardian Defined

In Arizona, a guardian is someone who is appointed by the court to make personal and health care decisions for the incapacitated person. Pursuant to A.R.S. 14-1204(23) A Guardian is defined as: “…a person who has qualified as a guardian of a minor or incapacitated person pursuant to testamentary or court
appointment but excludes a person who is merely a guardian ad litem.”

A guardian has similar powers as a parent has with a minor child. A guardian makes all decisions regarding where the ward lives and consents to medical care and treatment. The guardian must act in the ward’s best interest and take his or her values and wishes into consideration.
