Estate recovery, in its simplest terms, refers to the process by which the Medicaid state agency, or an agency or political subdivision responsible for such work under state law, attempts to recover from the estates of deceased Medicaid recipients of medical assistance, or the estates of spouses of such previously deceased Medicaid recipients, the value of Medicaid assistance properly provided on behalf of that recipient.
