Computer forensics is the application of computer knowledge and skills to legal problems involving digital evidence. In covenant litigation evidentiary problems can involve several different subjects. Clearly, it can involve the examination of facts surrounding compliance or non-compliance with the covenant provisions. In addition, computer forensics is often essential to determine whether sensitive information has been taken from the former employer and whether it has been used at the new employer.
E-discovery is the pretrial request and production of digital evidence. In covenant litigation the digital evidence can be quite voluminous particularly once the documents related to the defendant’s defenses are included. As a result, there is great need for the attorney in covenant cases to be very knowledgeable about digital evidence issues.
