Basic Legal Regulation of Medical Records

 
The Health Insurance Portability and Accountability Act of 1996, “affectionately”
known as HIPAA, was signed into law August 21, 1996. HIPAA contains different
sections. Title I offers protection for the health insurance of employees when they change or lose their jobs. Title II, which is the “Administrative Simplification” portion of HIPAA, contains the provisions that have received so much attention in recent years. The overall purpose of this Title was to address concerns that technological advances in the health care industry were threatening patient’s privacy. Under this Title, Congress required the Department of Health and Human Services (“HHS”) to promulgate regulations that, in part, set national standards for health information privacy and security. The regulations that were subsequently adopted by HHS basically have three components that are pertinent to the scope of this seminar: (1) the Privacy Rule, (2) the Security Rule, and (3), the Enforcement Rule.
