Dress Code Liabilities

Find out everything you need to know to have a tactful, up-to-date, compliant dress code policy.

Many employers utilize policies, which govern appropriate dress and grooming standards for employees in the workplace. In other circumstances, employees may rely upon common sense and good judgment regarding their appearance and clothing in the workplace, or employers may choose to give employees examples of what is appropriate and inappropriate attire. In doing so, however, employers need to be mindful of the potential implications under federal laws such as Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act, state laws, as well as the National Labor Relations Act. This material will advise you on the potential forms of discrimination that may arise due to a dress code policy and will outline how to appropriately respond to requests for accommodations. This course will also review how to address slogans and messages on clothing that may be deemed offensive and how to address other thorny topics, including body tattoos, piercings, and body odor. You will also learn that a properly drafted dress code will not only help to maintain a professional atmosphere that is conducive to the employer's business environment but will also play a critical role in limiting an employer's legal exposure.
